Generally, you will have 3 years from the date of your accident in which to pursue a compensation claim for personal injury. This time limit is known as the limitation date. In some circumstances it might be possible for the Court to extend the limitation period.
There are some exceptions to this. For instance, if at the accident date you were under 18 years or a person suffering from a mental disability .
If you are pursuing a work related disease (e.g. asbestos related or RSI), the 3 year limitation period would run from the date you first became aware of the condition and that it was related to your work.
If a person is part way through a personal injury claim when they die, the 3 year limitation period would generally begin again from the date of their death to enable their family to pursue the claim.
Note victims of violent crime can apply for compensation from the Criminal Injuries Compensation Authority. This is a different type of claim to which there is a strict 2 year time limit.
