Will I have to pay for the Defendant's costs if I lose my claim?
This liability can only happen if you start but lose Court proceedings. You should not have to pay the Defendant’s costs if you lose, because we should be able to insure you against this. We will not let you start proceedings without adequate insurance. If you do not already have the benefit of before the event legal expenses insurance we would look to take out an after the event legal expenses insurance policy for you, at no cost to you. This would protect you against potential liability for the Defendant’s legal costs in the event you were to lose your claim after you had served proceedings.
