Our Construction team has extensive experience in all forms of construction and engineering contracts. We work with clients across the public and private sectors, advising on and drafting both standard and bespoke construction documentation.
We appreciate that getting the balance of risk right at the beginning of a construction project is vital. Too much risk transferred to the contractor and the client pays a hefty premium but too little and the client may be exposed to unmanageable risk. We believe in getting to know our clients to ensure we draft the most appropriate contract based on their risk profile.
We are experienced in all forms of construction and engineering contracts such as the Joint Contracts Tribunal (JCT) suite of main and sub contracts and the New Engineering Contract (NEC3) family. We have a long track record of advising contractors, property developers, NHS Trusts, private hospitals, funders, architects, engineers and sub-consultants.
Appointing your construction team
Appointing your team is a crucial step in any construction project and we can advise on the most appropriate contract to implement. We have expertise in all the standard forms such as the Royal Institute of British Architects (RIBA), Royal Institution of Chartered Surveyors (RICS), the Association of Consulting Engineers (ACE) and the New Engineering Contract (NEC3) Professional Services Contract and can amend them to suit the needs of your project.
We are also aware that many clients prefer their own bespoke in-house documentation and we are experienced in drafting contracts to suit individual needs.
We know that no construction project can get underway without finance, provided either by the bank or from stakeholders in the project. These parties must ensure that their investment is properly safeguarded in the tricky construction phase.
We can draft documentation which meets the needs of both developers and funders. If you are seeking to secure funds, we can advise on funders’ requirements including collateral warranties, building contract and professional appointment documentation.
If you are a stakeholder lending money, we can advise you on the terms of warranties to protect your investment, including step-in rights. We can also carry out due diligence on the project documentation to ensure it works for you.
