Divorce reform has been placed firmly back on the government’s agenda for 2020 with The Divorce, Separation and Dissolution Bill being introduced to the House of Lords on 7 January. The bill sets out the proposed reforms of divorce law that do not undermine the institute of marriage.
Current law requires spouses to evidence at least one of five ‘facts’: adultery, behaviour, desertion, two years’ separation (if the other spouse consents to the divorce), or five years’ separation (if the other spouse disagrees). The bill will replace these requirements and instead, spouses shall make a statement of irretrievable breakdown. There shall also be a new option for a joint application to be made in cases where the decision to divorce is a mutual one. The possibility of contesting the decision to divorce will be removed and the court will be able to make a conditional order once 20 weeks has passed from the start of proceedings. Similar changes will also be made to the law governing the dissolution of civil partnerships.
It is promising that the government has chosen no-fault divorce as the focus for one of its first bills tabled in the new parliament. The proposed changes are long overdue and should make it much easier for separating couples to move on with their lives without acrimony.

If your spouse has chosen to issue divorce proceedings, we are able to assist you for a fixed fee of £350 plus VAT.
