• It has been reported that an Employment Tribunal (in the case of White -v- Dudley Metropolitan Borough Council) has ruled that voluntary overtime which is worked regularly should be included for the purposes of calculating holiday pay, as the overtime formed part of normal work. What is ‘regular’ is still to be defined.

    This is a first instance case so is not binding and could also yet be appealed. However, this case is likely to be closely watched as it appears to be the first decision around ‘voluntary overtime’ in the UK.
