Argos sickness bonus – positive reinforcement or disability discrimination risk?
Argos has offered its agency workers an 80p an hour bonus in the run-up to Christmas if they don’t call in sick.

Arguably this is a positive step and clearly intended to ensure staff are available over this busy time.
However, commentators have raised concerns about the risk this could be seen as disability discrimination if a worker is off sick due to a disability or medical condition. Argos has made a statement that they ‘do not tolerate discrimination and fully comply with the Equality Act 2010’.
Indirect discrimination can be objectively justified, however, to show that an employer has to be able to establish that there is a business and that the step taken is proportionate.
