When a hospital misdiagnosis leads to the death of an elderly patient, we aimed to reduce the stress on our client and ensured an early settlement

Misdiagnosis Medical Negligence Claim

Harriet Humphrey has recently successfully settled a no win no fee medical negligence claim in respect of the death of a 79 year old man in hospital. Mr M was admitted to hospital with abdominal pain and having vomited. There were concerns raised about his dementia status. Despite a full examination noting that an abdominal x-ray was required, this was not carried out. Mr M's symptoms continued and he remained uncomfortable and complaining of nausea.

3 days after admission, no further investigations having been carried out, Mr M tragically died of a cardiac arrest caused by an intestinal obstruction. The obstruction should have been diagnosed and treated earlier.

The care Mr M received was inadequate and the circumstances surrounding his death were extremely distressing for his family. Brachers Associate Harriet ensured the client was kept fully informed at all stages of this hospital negligence claim and an early settlement was obtained for Mr M’s family. However, the case is a concerning example of the times that the elderly are failed in hospital.

Elderly patients can be particularly vulnerable to hospital errors due to difficulties in communication and / or the fact that they may have multiple physical conditions. Unfortunately, the elderly in hospital may not be able to clearly explain their condition and may have attention distracted from their physical complaints as a result of issues such as dementia.

If you are concerned that you or a family member have not received adequate care leading to injury or death then our specialist no win no fee team are able to assist. We can advise about whether there may be a claim for compensation and we can also represent families at inquests. We understand how distressing these types of situations can be and have experience in helping clients at these times.
