• In a recent case, we attended one of our clients in hospital to take instructions about preparing a lasting power of attorney (LPA) for health and welfare. Once instructions were taken and the LPA had been signed, sadly the client began to lose capacity quite rapidly which required her being transferred from hospital into a hospice.

    LPAs are not legally effective until they have been formally registered with the Office of the Public Guardian. In this case, whilst the LPA had been submitted for registration, it had not been registered at the time it was needed. However, nevertheless, the hospice took the LPA as an indication of the wishes of the client and they were comfortable taking instructions from her family members about her health and welfare treatment.

    Sadly, the client died shortly after her transfer to the hospice, but comfort was given to the family members by being involved in decisions relating to her care.
