What is an injunction?
An injunction is a court order which requires someone to do or stop doing a certain action.
The person named in the injunction can be arrested if they break the terms of the court order.
You do not have to tell someone in advance if you are taking out an injunction. But once you have applied, they must be ‘served’ (notified), which can be arranged by your solicitor or the court.
Protection from domestic violence and harassment
Our solicitors can advise you on obtaining an injunction if you have experienced domestic abuse.
This can be used to:
- Keep a spouse, partner or relative at a distance from you or your child (known as a ‘non-molestation order’)
- Give you rights of occupation in the family home and prevent the person named in the injunction from entering the surrounding area (known as an ‘occupation order’)

Freezing injunctions and financial injunctions
If you are separating or divorcing, our family law team can also advise you on using injunctions to prevent the misuse or disposal of assets.
This may involve asking the court to freeze assets or to set aside transactions, including:

- Transfers to third parties
- Placement of funds or shares into trusts
- The transfer of assets out of the jurisdiction
This type of injunction may be necessary if assets are held or controlled by your spouse and you are concerned they are taking action to prevent the court finding out about these assets.
